Privacy policy

Who is responsible for your data

BramleyCase Ltd, company number 16842731, of 44 Percy Rd, Hampton TW12 2JU, United Kingdom is the data controller for the personal data described in this policy. Questions about data protection should be sent to lawconsult@bordermaintenance.co.uk or by post to the address above, marked for the attention of the data protection contact. We aim to answer any data protection query within five working days.

What we collect and why

If you use the enquiry form we collect the name, email address, telephone number and description of the matter that you enter. If you telephone us we make a short written note of the call. If you instruct us we also hold the documents you send, our correspondence with you and with the other side, and our record of fees charged and paid.

Our lawful basis for handling enquiry data is our legitimate interest in responding to a request that you have made of us. Once you instruct us, the lawful basis becomes performance of a contract. Where documents you send contain special category data, for example health information used to explain a delay, we handle it only so far as it is necessary for the establishment, exercise or defence of legal claims.

Who else sees it

We send correspondence to the other party in your matter, because that is the point of the work. We do not sell personal data, we do not share it for advertising, and we do not pass it to third party marketing lists. Our email and file storage are provided by suppliers operating within the United Kingdom or the European Economic Area. We do not routinely transfer personal data outside the United Kingdom.

How long we keep it

Enquiries that do not become instructions are deleted after twelve months. Closed client files are kept for six years from the date the file is closed, which reflects the limitation period for a simple contract claim under the Limitation Act 1980, and are then destroyed. Accounting records are kept for the period required by HM Revenue and Customs.

Your rights

You may ask for a copy of the personal data we hold about you, ask us to correct it if it is wrong, ask us to delete it, object to our processing of it, or ask us to restrict processing while a dispute about accuracy is resolved. We do not charge for this and we will respond within one calendar month. If you are not satisfied with our answer you may complain to the Information Commissioner’s Office at ico.org.uk or on 0303 123 1113.

This policy may be updated. Where a change is material we will note the new version number and date at the top of this page rather than change the text silently.
